1. Scope of Practice

Holistic Spartan is operated by a Harvard-Certified Holistic Nutrition Consultant based in Naples, Florida. Our services constitute wellness education and holistic nutrition consulting under Florida law. We are NOT a licensed medical practice, dietitian service, or healthcare provider.

The term "Holistic Nutrition Consultant" as used throughout this site means an individual certified in holistic nutrition principles through Harvard's Healthy Eating program and related wellness education. This title does not confer any state licensure for medical practice, diagnosis, or treatment.

2. No Medical Advice

All content on holistic-spartan.com — including all AI responses, coaching sessions, blog articles, meal plans, supplement suggestions, and any other materials — is for educational and informational purposes only. Nothing on this platform constitutes medical advice, diagnosis, treatment, or any licensed healthcare service.

You must consult a licensed physician, registered dietitian, or other qualified healthcare professional before making any changes to your diet, exercise routine, supplementation, or lifestyle, especially if you have a pre-existing medical condition, are pregnant, nursing, or taking medications.

3. Age Restriction

Our services are intended exclusively for users 18 years of age and older. By accessing or using Holistic Spartan, you represent and warrant that you are at least 18 years old. Users under 18 are not permitted to create accounts, subscribe to any plans, or submit personal health information.

If you are under 18, you must obtain parental or guardian consent and supervision before using any features of this platform.

4. User Data Storage

Your personal data — including email address, chat history, health goals, dietary preferences, and any health information you voluntarily share — is stored using Supabase infrastructure.

IMPORTANT: Holistic Spartan is NOT HIPAA-compliant and should not be used to store sensitive protected health information (PHI) as defined under HIPAA. Do not share information that you would only share with a licensed healthcare provider under a HIPAA-covered relationship.

Data is encrypted at rest and in transit using industry-standard protocols. We do not sell your personal data to third parties.

5. Subscription Terms

Free Trial: A 7-day free trial is offered for new subscribers to the Warrior plan. Full Warrior access is granted during the trial period. A valid payment method is required to begin a trial. If not cancelled before the trial period ends, your subscription will automatically convert to a paid Warrior Monthly plan at the then-current rate.

Warrior Plan: $29/month or $249/year. Billed automatically on your billing anniversary date.

Spartan Elite Plan: $79/month or $699/year. Billed automatically on your billing anniversary date.

1-on-1 Coaching: Single session, Duo Pack, Weekly Warrior, and Elite Legacy packages are available. Coaching packages are billed at time of purchase.

6. Cancellation Policy

Monthly and annual subscriptions may be cancelled at any time through your account settings or by contacting coach@holistic-spartan.com. Upon cancellation, your access continues until the end of the current billing period. No partial refunds are provided for unused time in a billing period that has already been charged.

Free trial cancellations: Cancel before day 8 to avoid being charged. Cancellations after conversion to a paid plan follow the standard cancellation policy.

1-on-1 coaching sessions: Rescheduling is permitted with 24 hours' notice. No-shows or cancellations with less than 24 hours' notice forfeit the session.

7. Prohibited Uses

You agree not to: (1) use the services for any unlawful purpose; (2) attempt to access other users' data or accounts; (3) use any automated tools to scrape or extract content; (4) share login credentials with others; (5) use AI responses to make medical decisions without consulting a licensed provider; (6) misrepresent your identity or qualifications; (7) use the platform if under 18 years of age.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Holistic Spartan and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, AI responses, coaching services, or any content provided herein.

Your use of the platform is at your sole risk. Results described in testimonials are individual experiences and are not guaranteed. Individual outcomes vary based on genetics, consistency, lifestyle, and other factors.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Collier County, Florida.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of the platform after changes are posted constitutes acceptance of the revised terms.
